Tribunal victory for gender-fluid Jaguar Land Rover engineer extends discrimination law to non-binary people

AN EMPLOYEE at Jaguar Land Rover, who identifies as gender-fluid, has won a landmark discrimination claim.

Ms R Taylor successfully argued she was harassed following her gender reassignment whilst working for the car manufacturer.

Her barrister Robin White said Ms Taylor had worked for JLR for 20 years as an engineer.

In her claim, Ms Taylor said her access to toilets was restricted and she was the subject of abusive jokes from colleagues.




Winning the tribunal claim extends discrimination protections to non-binary and gender fluid people under the Equality Act.

In the ruling on Monday, employment judge P Hughes said Jaguar Land Rover had treated Ms Taylor in an ‘egregious way.’


She said she was forced to resign in 2018 because of the harassment and discrimination she faced while working for JLR.

After a change of heart of the resignation, Ms Taylor said she suffered victimisation as the company did not allow her to take up her former role.

It is believed the ruling at the Birmingham Employment Tribunal will allow people who identify themselves on a gender ‘spectrum’ rather than an established gender identity, such as non-binary people, to seek redress under the Equality Act.

Damages will be awarded at a hearing in October, which the judge said would be ‘aggravated.’

Dave Williams, JLR’s director of human resources, said: “On behalf of Jaguar Land Rover, I would like to apologise to Ms Taylor for the experiences she had during her employment with us.

“We continue to strive to improve in this area and we respect the outcome of the case.”
